I want a divorce, How do I get divorced?
Contact your trusted attorney who will either mediate a settlement between the parties and draw up a parenting plan where minor children are involved, whereafter summons will be issued encompassing the settlement and parenting plan; where mediation is rejected or fails, your attorney will issue summons and serve via the sheriff, thus beginning the opposed divorce proceedings.
My parent has passed away, what do I do?
Find the original last will and testament, the death certificate and the deceased’s identity document. Then create a list of assets and liabilities for the deceased. An executor will have been appointed in the will, and it is this person who should contact their trusted attorney who will report the estate to the master.
My loved one passed away and left no will, what do I do?
In this situation, the deceased’s estate will devolve in terms of the Intestate Succession Act. Collate a list of family members and direct relations, and then contact your trusted attorney who will guide you through the process of reporting the estate to the master.
My tenant is not paying rent, can I turn off the services and lock them out of my property?
This was the reason the PIE Act was enacted. It prevents the landlord from taking the law into their own hands, and where the landlord acts in contravention of the PIE Act, they may face criminal or civil charges. The PIE Act does not take the landlords rights away, it merely delays the exercise thereof pending a decision of the court after considering the relevant circumstances and finding it is just and equitable to evict the unlawful occupier.
How do I evict my tenant who is in unlawful occupation of my property?
The landlord has to obtain a court order to evict an unlawful occupier by following the PIE procedure as set out in terms of Section 4 to 6 of the PIE Act. (Prevention of Illegal eviction from and Unlawful Occupation of Land Act, 1998). General overview of the steps involved:
